Affiliate Agreement

This Affiliate Agreement is between you and Value Hype Media, the operator of PublicBets.com. It governs your participation in the PublicBets.com affiliate referral program. By using an affiliate link, referring users, or accepting commissions, you agree to this Agreement, our Terms of Service, and all applicable laws.

1. Eligibility and Enrollment

Affiliate participation is available only to users who meet our account, subscription, age, jurisdiction, and verification requirements. You must be at least 18 years old, or the minimum legal age required in your jurisdiction, whichever is higher.

We may approve, reject, suspend, or terminate affiliate access at any time if we believe participation creates legal, payment, fraud, security, brand, or operational risk.

2. Referral Tracking

Eligible referrals must use your unique referral link or another tracking method we approve. We are not responsible for referrals that are not tracked because of browser settings, cookie blocking, link misuse, expired tracking, user error, third-party interference, or technical issues outside our reasonable control.

Self-referrals, duplicate accounts, fake accounts, incentivized abuse, payment manipulation, cookie stuffing, forced clicks, hidden redirects, and other artificial tracking methods are prohibited.

3. Commissions

Commission rates, referral limits, lock periods, and eligible plans are shown in your account dashboard, pricing page, or other program materials. Commissions apply only to eligible, tracked, paid subscription revenue that is actually received by us and not refunded, charged back, reversed, credited, disputed, fraudulent, or otherwise disqualified.

We may adjust, delay, reverse, or deny commissions to account for refunds, chargebacks, disputes, failed payments, taxes, credits, fraud, account abuse, policy violations, or tracking errors. Commissions are not earned until they become payable under this Agreement and are approved by us.

No income, conversion rate, or earning amount is guaranteed. Affiliate results vary and depend on lawful promotion, audience, subscription activity, cancellations, refunds, and other factors.

4. Payouts and Administration Fee

Commissions may be subject to a lock or review period before they become payable. You must provide accurate payout and tax information when requested. We may withhold or delay payouts until verification is complete.

A 10% administration fee applies to affiliate payouts and is deducted from the commission amount before payment. Payment providers, banks, currency conversion providers, or intermediaries may charge additional fees that are outside our control.

You are responsible for all taxes, reporting, forms, registrations, and obligations related to affiliate income in your jurisdiction.

5. Marketing Rules

You must promote PublicBets.com honestly, lawfully, and in a way that does not mislead users. You must clearly disclose your affiliate relationship and that you may earn a commission when someone subscribes through your link.

You must not make claims that PublicBets.com guarantees betting profits, guaranteed picks, guaranteed outcomes, risk-free betting, sportsbook status, official league affiliation, or endorsement by any person, sportsbook, league, team, regulator, or platform unless we have approved that claim in writing.

You are responsible for complying with all advertising, email, anti-spam, privacy, consumer protection, gambling, endorsement, affiliate disclosure, and platform rules that apply to your promotions.

We may require identity, account, payment, tax, traffic-source, or promotional-method verification. We may ask you to remove or correct promotional content that violates this Agreement or creates risk. Failure to cooperate may result in withheld commissions, account restrictions, or termination.

8. Intellectual Property

We grant you a limited, revocable, non-exclusive, non-transferable license to use approved PublicBets.com names, logos, links, and materials only to promote the program in compliance with this Agreement. We may revoke this license at any time.

You may not modify our materials in a misleading way, register domains or social handles containing our brand, imply ownership of our brand, or use our marks in a way that harms our reputation.

9. Termination

You may stop participating at any time by ceasing promotional activity and canceling or disabling your affiliate use where available. We may suspend or terminate your affiliate access at any time, with or without notice.

If we terminate or suspend your participation for suspected fraud, prohibited marketing, legal risk, payment abuse, or violation of this Agreement, we may withhold, cancel, or forfeit unpaid commissions to the fullest extent permitted by law.

10. Relationship of the Parties

This Agreement does not create an employment, agency, partnership, joint venture, franchise, or representative relationship. You may not bind Value Hype Media, make commitments on our behalf, or represent that you are employed by us.

11. Limitation of Liability

The affiliate program is provided "as is" and "as available." To the fullest extent permitted by law, Value Hype Media will not be liable for indirect, incidental, consequential, special, punitive, exemplary, lost-profit, or lost-revenue damages related to the program, tracking, commissions, payouts, account restrictions, or termination.

12. Governing Law and Disputes

This Agreement is governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Any legal action or proceeding arising from this Agreement must be brought in the courts located in Ontario, Canada, and you consent to jurisdiction and venue in those courts.

13. Changes to This Agreement

We may update this Agreement at any time by posting the updated version on the Site. Your continued participation in the affiliate program after changes are posted means you accept the updated Agreement.
