Affiliate Agreement

This Affiliate Agreement (the “Agreement”) contains the complete terms and conditions between PublicBets.com (“we,” “us,” or “our”) and you, regarding your participation in our Affiliate Program (the “Program”). By signing up or participating in the Program, you agree to the following:

1. Enrollment in the Affiliate Program

1.1 Automatic Enrollment

By subscribing to any of our paid plans (Silver, Gold, or Platinum), you automatically become an Affiliate. No separate application is required.

1.2 Limited Referral Slots

Each plan allows a limited number of new member referrals per month to protect against fraudulent registrations and payments. The exact referral limits are detailed in your account dashboard.

1.3 Compliance

All affiliates must comply with this Agreement, our general Terms of Service, and all applicable laws and regulations. Any breach may lead to suspension or termination of your account.

2. Referral Tracking & Commissions

2.1 Unique Tracking Links

All referrals must use your unique affiliate link provided in your account dashboard. We are not responsible for tracking errors that result from misuse or tampering with tracking links.

2.2 Commission Rates

Your commission rate is determined by your subscription plan:

  • Basic Plan: no referral revenue
  • Premium Plan: 30% recurring commission on each paying referral
  • Premium Plus Plan: 50% recurring commission on each paying referral

2.3 Upgrades & Commission Rates

If you upgrade to a higher plan with a better commission rate, only new referrals moving forward will earn you the new rate. Commissions from existing referrals remain at the previously applicable rate.

2.4 Locked Commissions

All commissions are locked for 90 days after the initial payment. During this lock period, refunds, chargebacks, or cancellations will result in commission adjustments.

3. Payment Terms

3.1 Payout Lock Period

Commissions become payable once the 90-day lock period has passed. For instance, a referral made on January 10 will be payable on April 10 (assuming no refunds or cancellations).

3.2 Payout Method

We offer payouts via PayPal or Wise. You are responsible for setting up and maintaining these accounts. You must ensure the correct email address (for PayPal) or account details (for Wise) are provided.

3.3 Requesting Payouts

You must manually request your payout. If you do not request it by the 1st of the month, the balance will carry over to the next month. You are allowed to request only one payout every 30 days.

3.4 Administration Fee

A 5% administration fee applies to all payouts. This fee covers processing expenses and is deducted from your total commission payout.

3.5 Forfeiture of Commissions

If your account is suspended or banned for fraudulent activity, spam, or hacking attempts, all accumulated commissions will be forfeited.

Any chargebacks on affiliate transactions will result in commission adjustments.

4. Subscription Changes & Cancellations

4.1 Active Subscription Required

You must maintain an active, paid subscription to retain your referrals and continue earning commission. If you cancel your membership or fail to pay your monthly fee, you will lose all your referrals and any associated affiliate revenue. Restarting your subscription will not restore lost referrals.

4.2 Plan Upgrades

Upgrading your plan will apply only to new referrals after the upgrade date. Commissions from old referrals remain under the previous plan rate.

5. Prohibited Activities

5.1 Spam & Fraud

Spam emails, unsolicited messages, hacking attempts, or any form of fraudulent activity are strictly prohibited. Violations will result in immediate suspension or ban, and all accumulated commissions will be forfeited.

5.2 Multiple Accounts

You are not permitted to create multiple accounts to circumvent referral limits or artificially boost commissions. We reserve the right to request user ID, billing information, and a selfie for identity verification purposes.

5.3 Solicitation Limitations

You agree not to solicit services beyond your own social media channels allowed on our website. Any unauthorized marketing activities may lead to account suspension.

5.4 Fraudulent Accounts

We reserve the right to cancel any account found to be fraudulent or involved in fraudulent activities. All associated commissions will be forfeited.

6. Payout Details & Verification

6.1 Payout Email Verification

If you choose PayPal or Wise as your payout method, your affiliate account email should match your PayPal email. If you prefer an alternate email, it must be verified through a link sent to your primary email on file.

6.2 Identity Verification

We may require additional verification for compliance and security reasons, including but not limited to a government-issued ID, utility bill, or selfie. Failure to comply may result in suspension or termination.

7. Taxes

You are solely responsible for any tax obligations arising from your Affiliate commissions, including income, sales, or any other relevant taxes, as required by the laws in your jurisdiction.

8. Term & Termination

8.1 Term

This Agreement remains effective as long as you maintain an active subscription and abide by the terms herein.

8.2 Termination by You

You may terminate your affiliate status at any time by canceling your Premium or Premium Plus subscription and ceasing promotional activities.

8.3 Termination by Us

We reserve the right to terminate or suspend any account at our discretion, with or without notice, especially in cases of suspected fraud, non-compliance, or abuse.

8.4 Effect of Termination

Upon termination for any reason, you will forfeit all referrals, associated commissions, and access to any affiliate resources. No pending or future payouts will be due.

9. Intellectual Property

9.1 License

We grant you a limited, non-exclusive, non-transferable license to use our trademarks, logos, and other promotional materials for the sole purpose of marketing our subscription plans within the scope of this Agreement.

9.2 Restrictions

All intellectual property rights remain with us. You shall not modify our materials or present them in a way that may harm our brand or reputation.

10. Limitation of Liability

We make no warranties regarding the performance or functionality of the Program or the website. We are not liable for any indirect, incidental, or consequential damages, loss of data, or revenue in connection with this Agreement.

11. Governing Law & Disputes

This Agreement is governed by the laws of Ontario, Canada without regard to conflict-of-law principles. Any disputes arising out of or relating to this Agreement shall be resolved in the courts of Ontario, Canada.

12. Modifications & Amendments

We reserve the right to update or modify this Agreement at any time. Notice of significant changes will be posted on our website or communicated via email. Your continued participation in the Program after any such update constitutes acceptance of the revised terms.

13. Entire Agreement

This Agreement, along with our general Terms of Service and any additional guidelines or rules posted on our website, constitutes the entire agreement between you and PublicBets.com and supersedes any prior or contemporaneous agreements.

By subscribing to our paid plans and participating in our Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by the above terms and conditions.
